The rules
Terms and conditions
These terms apply to every competition on this site. By entering, you agree to them.
Not yet reviewed by a solicitor
This wording is a working draft written to reflect how the competition actually operates. It is not legal advice and it has not been checked by a solicitor. Have it reviewed by someone qualified in UK competition, consumer and data protection law before taking real money.
1. Who we are
AutoBarn Comps operates the website at autobarncomps.co.uk and runs the prize competitions promoted on it. Our registered company details, company number and registered office must be inserted here before the site goes live and takes payment.
2. What these competitions are
These are prize competitions, not lotteries and not gambling. Entry requires the correct answer to a question of skill, and a free entry route is available for every competition on equal terms. On that basis the competitions fall outside the licensing requirements of the Gambling Act 2005 and are not regulated by the Gambling Commission.
3. Eligibility
- You must be 18 or over on the date you enter.
- You must be resident in the United Kingdom.
- Employees, officers and contractors of AutoBarn Comps, and their immediate families, may not enter.
- We may ask for proof of age and identity before releasing a prize, and we will withhold a prize until it is provided.
4. Entering
- Each competition states its ticket price, total ticket count, per-person limit, closing time and draw time. Those details are the contract.
- Entry is complete only when payment has cleared and a correct answer has been given. Adding tickets to a basket reserves nothing.
- Ticket numbers are allocated at random from unsold numbers at the point of payment.
- An incorrect answer to the question of skill invalidates the entry. We will refund the ticket price in full.
- We may void entries we reasonably believe to be fraudulent, automated, or made in breach of a per-person limit.
5. Free entry route
A free postal entry route is available for every competition and carries identical odds and identical standing in the draw. The method is set out in full on the free entry pageand forms part of these terms.
6. Closing and the draw
- A competition closes at the published closing time, or earlier if every ticket sells.
- The winning number is drawn at random from 1 to the total ticket count, filmed, and published.
- Unsold tickets remain in the draw. If the drawn number was never sold, the advertised prize is not awarded. In that case a cash prize equal to 50% of the ticket revenue actually received is drawn at random among valid entrants. This is stated plainly because it materially affects what you are buying.
- The draw is final. We do not rerun a draw because of the result.
7. Prizes
- The prize is as described on the competition page. Photographs are illustrative.
- Where a cash alternative is stated, the winner may choose it. Where none is stated, there is none.
- Vehicles are supplied with the history described and delivered free within mainland UK.
- Insurance, ongoing road tax, fuel and running costs are the winner's responsibility.
- Prizes are not transferable before they are claimed.
- We will never ask a winner for a payment of any kind to release a prize.
8. Claiming
We contact the winner by phone and email on the day of the draw using the details on the order. If we have not reached the winner within 21 days, having made reasonable attempts, we may redraw. Keep your contact details current.
9. Cancellation and refunds
- Entries are non-refundable once the draw has taken place, except where these terms say otherwise.
- If we cancel a competition, every entrant is refunded in full and that is our entire liability.
- As entry is to a competition with a fixed closing date, the 14-day cancellation right under the Consumer Contracts Regulations does not apply once the draw has taken place.
10. Conduct
We may refuse entry, void entries and close accounts where someone abuses the service, harasses staff or other entrants, attempts to manipulate a draw, or breaches these terms. Where we do that in circumstances that are not the entrant's fault, we refund.
11. Liability
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our liability in connection with any competition is limited to the amount you paid to enter it.
12. Your data
We handle personal data as described in our privacy policy.
13. Changes
We may change these terms, but changes do not apply retrospectively to competitions you have already entered. The version that applies to your entry is the version published when you entered.
14. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
